General terms and conditions and right of withdrawal

1. Scope of Application

The following General Terms and Conditions apply to purchases made through the CrocoDi Design online shop. The inclusion of the customer's own terms and conditions is hereby rejected, unless otherwise agreed.

2. Contracting Parties

The purchase contract is concluded between the customer (buyer) and CrocoDi Design Diana Aman, Mainzer Str. 10, 55430 Oberwesel (seller). ​

 

3. Conclusion of Contract

By placing the products in the online shop, we submit a binding offer to conclude a contract for these items. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. You will receive a confirmation by email after submitting your order. A binding contract can also be concluded beforehand if you have chosen PayPal as your payment method, as the contract is then concluded at the time you confirm the payment instruction to PayPal.

4. Payment Options

You can choose between various payment methods in the online shop:

a) Advance Payment If you choose advance payment, we will provide you with our bank details in the order confirmation and will deliver the goods after receipt of payment.

b) PayPal You will pay the invoice amount via the online provider PayPal. You must be registered there or register, authenticate yourself with your login details, and confirm the payment instruction to us on the PayPal platform.

c) Credit Card (Visa, Mastercard, Amex, etc.) There are no fees for using credit cards when making purchases. The invoice amount will be debited from your credit card account according to your personal settings with the bank. The credit card will be charged when you place an order through the online shop. Fees may apply when canceling the purchase depending on the credit card payment method.

d) Klarna (Instant Bank Transfer) Payment is initially made to Klarna and is subject to Klarna's terms and conditions. For information about data protection and refunds, please contact the service provider directly. The goods will only be shipped after Klarna has received payment.

For deliveries to countries outside the European Union, additional costs may arise in individual cases, which must be borne by the customer. These include costs for money transfers through credit institutions (e.g., transfer fees, exchange rate fees) or import duties or taxes (e.g., customs duties). Such costs may also arise in relation to money transfers if the delivery is not made to a country outside the European Union, but the customer makes the payment from outside the EU. ​

 

5. Retention of Title

The goods remain the property of CrocoDi Design, Mainzer Str. 10, 55430 Oberwesel, until full payment has been received. ​

 

6. Manufacturing and Deviations

CrocoDi Design products are manufactured independently in Germany with great care, unless it is clearly stated that they are print-on-demand products manufactured by a third party. During the manufacturing process, slight variations in product size or, for example, the number of leaves may occur. The colors of the actual products may also differ slightly from the photo on the screen (online shop) or may be misleading on the screen. ​

 

7. Shipping Costs

Shipping costs are in addition to the product price and vary depending on the country to which the shipment is to be made. You can find more information in our shipping information. ​

 

8. Packstation

We do not ship to packing stations. ​

 

9. Transport Damage or Loss

If goods are delivered with obvious transport damage, CrocoDi Design must be notified within 5 days. If deliveries sent with a tracking number go missing and are not delivered, the delivery company is liable. We cannot accept liability for expressly requested deliveries without tracking. We are also not liable for loss or damage to goods if they were simply left at your delivery address, or if our shipment is not accepted by you personally (or, for example, a named neighbor) by the parcel delivery service commissioned by us, or for damage caused by parcel delivery times or other delivery obstacles beyond our control (e.g., incorrect address information in the order, missing house number, or missing recipient name on the front door), or in cases of "force majeure" that may arise due to delayed or impossible parcel delivery (e.g., road conditions that make it impossible to access the parcel, or driving bans in winter).

10. Delivery Address and Delivery Reservation

We ship to the delivery address provided by the customer on the order form. If PayPal is selected as the payment method, the delivery address provided by the customer to PayPal at the time of payment may be decisive. CrocoDi Design reserves the right to reject orders for commercial reasons – even without giving reasons. Errors and changes are expressly reserved.

 

11. Right of Withdrawal

Please note that the 14-day right of withdrawal obliges the seller to provide a full refund of the purchase price within 14 days of receipt of the goods. This right of withdrawal does not apply to consumers who are not members of a member state of the European Union at the time the contract is concluded and whose sole residence and delivery address are outside the European Union at the time the contract is concluded.

 

Please note that we only accept returns if the item is in its original condition, unused, undamaged, and in its original packaging. Returns that do not meet these requirements will not be accepted.  

A refund will only be issued after the items have been returned to CrocoDi Design and inspected for their condition. Returns are at your own expense and are not covered by CrocoDi Design. Returns must be initiated with a tracking number, which must be provided to CrocoDi Design to confirm shipment. If the return is due to damage or a defect in the product, this must be reported to CrocoDi Design within 5 days of receipt of the goods to reach an agreement. We ask that you provide photographic evidence. Returns due to color variations on the screen will not be accepted.

Please note that the color may appear different on the screen than on the physical product. If the damage or defect is due to delivery, see point 8.

We reserve the right to exclude customers who initiate multiple returns within a short period of time from further purchases. As a small company, complaints represent a significant time and cost burden for us, which we cannot afford to deal with on a permanent basis. ​

12. Warranty and Guarantees

The statutory warranty for defects applies. Please also refer to our return policy.

 

13. Contract Language

The contract language is German.
